These Terms of Service ("Terms") govern your access to and use of the website located at chartbriefs.com (the “Site”) and all services provided by Chart Biopsy, LP (“Company,” “we,” “our,” or “us”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or the services it offers.
To use our services, you must be at least 18 years old and capable of entering into legally binding contracts. If you are registering on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. Organizational users must designate administrators who are responsible for managing team members, document visibility, and compliance within the platform.
Our platform allows users to upload documents which are then analyzed and organized using artificial intelligence models, including AWS Bedrock, Amazon Textract, and other large language models. You retain full responsibility for the content you upload. You must not upload content that is unlawful, infringes intellectual property rights, or violates confidentiality agreements. We do not review documents for legality or appropriateness, and we are not responsible for how organizations manage internal visibility or access to uploaded files.
If your use of the platform involves a team or organizational account, the administrator of your organization is fully responsible for determining who has access to specific documents. We are not liable for any unintended access or internal misuse resulting from your organization’s failure to properly manage its permissions or users.
All payments are processed through Stripe. By submitting payment information, you authorize us to charge applicable fees to your payment method for subscriptions, services, or additional usage. Your subscription will renew automatically unless canceled before the next billing period. You can cancel your subscription through your account settings.
Our system is hosted on Amazon Web Services. We have a signed Business Associate Agreement (BAA) in place with AWS to ensure compliance with HIPAA. However, your organization is ultimately responsible for any obligations under HIPAA related to the content you upload. We do not access or use uploaded documents beyond automated processing, and we store documents in encrypted archives for 30 days, after which they are permanently deleted and cannot be recovered.
You are prohibited from using the Site in any manner that is illegal, attempts to breach or bypass system security, reverse engineers our services, or interferes with other users. We reserve the right to suspend or terminate accounts at our sole discretion if we believe they pose security risks, violate these Terms, or fail to maintain valid payment credentials.
Our services are provided “as is” and without warranties of any kind, express or implied. We do not guarantee that the platform will be error-free, uninterrupted, or that its output will be accurate or fit for a specific purpose. The use of AI models is subject to inherent limitations and may not always produce reliable or appropriate results.
To the fullest extent permitted by law, we disclaim liability for indirect, incidental, consequential, or special damages, including loss of data, loss of profits, or organizational mishandling of documents. Our total liability under these Terms will not exceed the amount you paid us in the twelve months preceding the claim.
These Terms may be updated from time to time. We will notify you of significant changes by posting them on the Site and updating the effective date. Continued use of the services after such changes will constitute your acceptance.
These Terms are governed by the laws of California. Any disputes arising under these Terms shall be resolved exclusively in the courts of XX.
